Weingarten Rights (Core Concept)

Weingarten Rights are among the most critical protections for union members. Named after the Supreme Court case NLRB v. J. Weingarten, Inc. (1975), these rights guarantee that union-represented employees can have a union representative present during investigatory interviews.

When Do Weingarten Rights Apply?

• The meeting must be an 'investigatory interview' — meaning management is investigating facts that could lead to discipline

• The employee must REASONABLY BELIEVE the meeting could lead to discipline

• The employee must REQUEST representation — management is NOT required to offer it

What the Steward Can Do During the Meeting:

• Consult with the member before the interview

• Speak during the meeting to clarify questions

• Request breaks to consult privately with the member

• Take notes

• Advise the member on how to answer questions

What the Steward Cannot Do:

• Answer questions for the member

• Obstruct or disrupt the interview

• Tell the member to refuse to answer

The Weingarten Statement (Members Should Know This):

'If this discussion could in any way lead to my being disciplined or terminated, I respectfully request that my union representative be present at this meeting. Until my representative arrives, I choose not to participate in this discussion.'

Management's Options When Representation is Requested:

1. Grant the request and wait for the steward

2. End the interview

3. Give the employee the choice of continuing without representation or ending the interview

Management CANNOT continue the interview without representation if the member has requested it.
